About
Karol Kuterek is an IT and data protection lawyer with a focus on technology and digital evolution. He advises clients on IT contracts, data protection, AI, cybersecurity and electronic communications law.  

Karol has acted for several leading Polish and international clients in drafting and negotiating IT contracts, including cloud services agreements, both on the provider and customer side. He is also experienced in advising on IT outsourcing agreements in highly regulated sectors such as banking, insurance and payment services, including advising on regulated outsourcing and negotiating cloud computing contracts in the financial sector. His expertise includes advising on software licensing and open source.  

Karol frequently advises on the legal aspects of the use of AI, including contracting, governance and compliance, as well as the implementation of the EU's Digital Decade regulations, including the AI Act, Data Act, DORA and NIS 2. 

Karol has expertise in advising on data protection matters, including GDPR and ePrivacy compliance of innovative business processes, drafting privacy policies, and drafting and negotiating data processing agreements and other data sharing agreements covering both personal and non-personal data. 

He is also experienced in advising on electronic communications matters, including market entry, radio licensing, spectrum reservation and regulatory compliance. 
 

EXPERIENCE

  • Advising major Polish and international banks on issues related to personal data protection.
  • Advising major international electronic communications companies on market entry in Poland and compliance with the local laws, including obtaining general authorisations and radio licences.
  • Advising CIM-mes Projekt on intellectual property issues related to development and commercialisation of particle modelling software ordered by the European Space Agency to be used in current and future missions (e.g. EL3, E3P).
  • Advising a major international company on drafting a comprehensive intra-group data transfer agreement regulating data flows between several dozen group companies worldwide.
  • Advising a major automotive manufacturer on data protection and regulatory issues related to development of autonomous vehicles.
  • Advising a major international technology company on the launch of cloud services in Poland.
  • Advising a major international media company on the launch of a video streaming service in Poland .
