False advertising 101 – September 15, 2021

In today’s rapidly evolving consumer landscape, brand content and advertising are woven into consumers’ lives in new and imaginative ways. At the same time, most industries face a growing volume of advertising claims. This presentation will discuss false advertising and how it is regulated and what companies can do to support their advertising claims and mitigate liability. We will highlight a few specific false advertising issues, as well as identifying general best practices for advertising.

Your brand is your image – but it is more than just a name or a logo. Valuable consumer recognition may derive from the look of your packaging, the tune of your jingle, or even the smell of your product.  This presentation will explore how trade dress law can be a powerful tool to distinguish your brand within the marketplace and how to protect those unconventional marks against encroaching competitors looking to free ride on your goodwill. We will look at the current status of the law and discuss ways to maximize the protectability of your non-traditional identifiers.
