Kade specialises in competition / antitrust law and the economic regulation of critical infrastructure.

With extensive experience across Australia and New Zealand, Kade advises on the full range of competition and regulatory matters, including merger control, enforcement and investigations, price control and other regulatory and public law issues.

He has particular expertise in the utilities sector, including electricity, gas, telecommunications, ports and airports. Kade acts for clients in both contentious and advisory matters. 

EXPERIENCE

  • Advised the ACCC on its investigation of Qantas' proposed acquisition of Alliance Airlines.
  • Advised the ACCC on its ‘digital platforms inquiry’, including on potential anticompetitive effects arising from Google’s contracts with OEMs.
  • Advised ASX-listed Dalrymple Bay Infrastructure on regulatory issues relating to access to its essential port infrastructure in Northern Queensland, including the preparation of an access undertaking and submissions advocating for a transition to a lighter handed form of regulation, which were accepted by the Queensland Competition Authority.
  • Acted for the ACCC in its successful applications in the Federal Court for interlocutory injunctions to block the acquisition of Adora Fertility by a subsidiary of ASX-listed IVF company Virtus Limited.
  • Acted for the Australian Energy Regulator in Federal Court proceedings against Hornsdale Power Reserve in relation to alleged breaches of the National Electricity Rules.
  • Advising the ACCC on its assessment of the variation proposed by NBN Co to the special access undertaking which regulates access to the national broadband network.
  • Advised various pipeline operators in their negotiations with access seekers under the negotiate/arbitrate regime set out in Part 23 of the National Gas Rules, including acting for Gas Pipelines Victoria against EnergyAustralia in the second access dispute arbitrated under the regime.
  • Advised various electricity distributors with respect to legal issues and regulatory strategy relevant to the AER’s distribution determinations which set the maximum revenues that can be charged by these businesses.
  • Acting for the ACCC in its proceedings against Honda Australia for alleged misrepresentations under Australian Consumer Law relating to the closure of former Honda dealerships.
