Navigating the post-Dobbs implications on data collection and disclosure

Following the Supreme Court’s reversal of Roe v. Wade in the Dobbs decision, states have enacted differing laws protecting and restricting abortion. Several states have put in place innovative regimes to punish third parties that either facilitate abortion or facilitate out-of-state prosecution thereof.

In response, the Biden Administration has urged federal agencies to use the tools at their disposal to protect access to sexual and reproductive healthcare, including abortion, pregnancy complications, and other related care. These new laws require renewed attention by employers and third parties to the collection and disclosure of health information and other private data, which transcends the Dobbs decision.
