About

Katie Grasso is an experienced trial attorney whose work covers a range of patent litigation matters pending throughout the United States. She has tried patent cases involving a variety of technologies, including medical devices, e-commerce, network security and anti-virus software, pharmaceuticals, and wireless communication devices.

Katie also has significant experience counselling clients and trying cases related to various employment matters, including wage and hour disputes, employment discrimination, and trade secret disputes.

EXPERIENCE

Katie's recent litigation matters include:

  • Covidien v. Ethicon: Represents Covidien in medical device patent infringement case
  • XPO Logistics, Inc.: Represents XPO in several wage and hour lawsuits pending in California
  • Sophos v. Fortinet: Represented Sophos in arbitration and district court proceedings related to trade secret misappropriation and patent infringement
  • Finjan Licensing v. McAfee, et al: Represented Sophos as trial counsel in complicated multi-defendant patent infringement case filed by Finjan in the District of Delaware involving two patents related to network security and antivirus software. Katie successfully argued for and obtained a reduction in damages from the court which resulted in the case going to the jury with a reduced risk for Sophos. Following a three week jury trial, the jury returned a complete defense verdict including a finding of non-infringement and invalidity for all the asserted claims. Finjan had previously prevailed on the same patents in the same venue against another defendant
  • Ergo Licensing v. CareFusion: Represented CareFusion in case filed in the District of Maine involving a patent related to a multichannel metering IV system. Successfully invalidated the patent on summary judgment. The patent holder appealed. We prevailed at the Federal Circuit
  • Biogen Idec and Genentech v. GlaxoSmithKline: Represented plaintiff patent holders in a patent infringement suit against GSK entities for infringement of a method of treatment patent to treat chronic lymphocytic leukemia
