About

Ben’s nationwide practice focuses on litigation against the government, appellate litigation, defending quasi-criminal civil litigation, and legal issues relating to brand protection. Ben represents clients across various sectors, including companies in the life sciences, consumer goods, telecommunications, and financial services sectors.

At the trial level, Ben has significant experience drafting dispositive motions and discovery motions; developing discovery, trial, and appellate strategies; and litigating cases through trial. He also has experience defending quasi-criminal civil actions, including antitrust, civil RICO, False Claims Act, unfair competition, trade secret misappropriation, counterfeiting, and fraud cases.  And he has experience prosecuting affirmative litigation against the government, including litigation challenging legislative enactments and administrative subpoenas, rules, and decisions.  Ben also advises clients on issues relating to corporate separateness and efforts to pierce the corporate veil.

At the appellate level, Ben has drafted dozens of merits briefs and amicus briefs in federal and state appeals courts.  He also has presented oral arguments before the U.S. Court of Appeals for the Seventh Circuit, federal district courts, and arbitration panels.

Ben maintains an active pro bono practice, focused primarily on civil rights, voting rights, and amicus advocacy in appellate courts.

Ben clerked for the Honorable Jane R. Roth, U.S. Court of Appeals for the Third Circuit, and the Honorable Paul S. Diamond, U.S. District Court for the Eastern District of Pennsylvania.
