About

Simone Zwartenkot is an experienced litigator who acts for both national and international clients, particularly in the area of financing, securities and commercial disputes. Her clients are mainly banks (i.a. all major Dutch banks) and commercial companies.

Simone advises and litigates on facility agreements, the establishment and enforcement of security rights, commercial disputes, prejudgment attachments (i.a. European Account Preservation Orders), netting, fraud and asset tracing, liability claims and duty of care issues.

Simone is one of our key litigators, with a strong and solution driven court performance. In 2020 she finished her post academic course in Finance & securities cum laude, and she currently lectures property law at the Law Firm School.

  • Acting for ING in litigation against one of its borrower in relation to a shipping finance arrangement
  • Representing Deutsche Bank in relation to the recovery of its claims against an international commodities trader in bankruptcy
  • Representing Rabobank in litigation against one of its borrowers in relation to a real estate investment project, including the arrangement of a European Account Preservation Order in Spain
  • Representing ING in litigation against a former client that was off-boarded for compliance reasons
  • Assisting Deutsche Bank with the settlement of the credit facility provided to a Dutch shipyard
  • Representing Utrecht University in the worldwide negotiations at both the Harvard University Model United Nations and the Cambridge University Model United Nations
