Felipe Massardo concentrates his professional practice in the Energy and Natural Resources area, especially in project development, environmental analysis, and general health matters for clients in the energy, infrastructure, construction, transportation, and telecommunications sectors.
In the Projects and Infrastructure area, Felipe advises clients in M&A processes, asset viability, and critical issues for developing infrastructure projects such as sea and land ports, large-scale industrial facilities, and drafting and negotiating EPC, EPCM, and O&M contracts.
In addition, Felipe is part of the area of Regulated Markets, in which he advises domestic and foreign clients from different industries in bidding processes, public works concessions, sanctioning procedures before various sectorial authorities, and litigation before specialized courts.
•Solarcentury Chile SpA: Advised the client in submitting an offer in the bidding process carried out by the Ministry of National Assets to obtain a concession of public lands for the development of three solar energy projects.
•Coca-Cola de Chile S.A.: Advised on the new obligations that arose for the client due to the entry into force of Act 20.920, establishes a framework for waste management, extended producer responsibility, and the promotion of recycling.
•E.ON Climate & Renewables Chile SpA: Permanent advice in corporate matters related to the landing of the Company in Chile for the development of energy projects in the country.
•CarbonFree Technology: Advised on acquiring and developing more than 20 solar projects. In addition, permanent legal assistance related to environmental and electrical matters arising in the context of the development of the projects owned by the client.
•Sky Solar Holding Ltd.: Advised on due diligence processes and drafting and negotiating relevant contracts for acquiring photovoltaic plants and transmission lines. In addition, permanent legal assistance related to environmental and electrical matters arosing in the context of the development of the projects owned by the client.
Regulated Markets
•Uber: Advised Uber Chile in multiple regulatory matters, including the introduction of rules aimed at regulating the services provided by online platforms. Also, permanent counseling to Uber and Uber Eats regarding applicable regulations in consumer protection, health, and retail, among other relevant sectors.Airbnb: Regulatory advice in matters of tourism and hotel regulations in Chile and their applicability to the app developed by the client.
•BASF Chile: Advised on matters related to the Agriculture and Livestock Service (SAG), the Regional Ministerial Secretaries of Health, and the applicable regulation of pesticides and other controlled substances.
•Kimberly-Clark Chile: Permanent counseling to the client in matters related to consumer protection and applicable regulation to the products of its line of business.
TMT (Telecommunications, Media, Technology)
•Canal Dos S.A.: Advised on the applicable regulation of the TV sector and representation before the National Television Council (CNTV) in administrative procedures.
•American Tower Chile S.A.: Counseling regarding telecommunication permits for installing and operating towers for antennas, as well as on the applicable regulation for concessionaries of intermediate telecommunication services.
•OneWeb: Assistance in the regulatory analysis of applicable laws to satellites in Chile, including the client's participation in the Public Consultation process for the national plan “5G para Chile”, called by the Undersecretary of Telecommunications.
Project Financing
•Itaú Corpbanca, Banco de Crédito del Perú S.A.S and Banco BICE: Advised the clients, as lenders, in regulatory, electric, and environmental matters related to the loan facility granted to three Atlántica Yield´s entities for the refinancing of the borrower’s debt governed under the laws of New York.
•Sky Solar Holding Ltd.: Advised on negotiating a credit with project finance guarantees for USD 35 million.
•CarbonFree Technology: Advised the company on negotiating credit with project finance guarantees for USD 107 million.
