Aoife Marrett is an associate in the Construction, Infrastructure and Engineering Disputes team based in London.

Aoife has extensive experience advising employers, contractors, suppliers, insurers and other interested parties on complex construction, engineering and infrastructure disputes in arbitration, litigation, adjudication and other forms of ADR. Aoife regularly utilises her Spanish and Portuguese language skills on matters.

Aoife has worked for clients across multiple sectors (including energy, infrastructure, manufacturing, residential and insurance) in relation to a wide variety of contentious issues that have arisen on high value projects around the world.

Aoife has developed a range of technical and sector specific experience including in relation to defects, delay, design liability, payment and termination. That knowledge allows her to understand complex matters quickly, scrutinise expert evidence and achieve excellent results for her clients.

EXPERIENCE

Energy and Natural Resources

  • Acting for supplier of solar energy units based in the Far East in an ICC arbitration brought by the main contractor. The claims concern delays and defects and are valued at over USD 330 million.
  • Acting for an EPC contractor in a dispute relating to a number of coal-fired power plants in Turkey. The dispute concerns the modernisation of the plants to deliver increased capacity and comply with current environmental standards. The sums in dispute exceed USD 150 million.
  • Acting for a consortium of major international EPC contractors based in the Far East and Middle East in an arbitration, pursuant to the ICC rules, brought by the main subcontractor. The claims and counterclaims are valued at over USD 300 million, and the issues include claims for delay, disruption, variations, valuation issues and scope changes, as well as counterclaims. The claims also turn on complex allegations of fraud and breach of good faith.
  • Acting for a multinational consultancy firm providing risk services, in relation to a claim brought against it in the High Court of Hong Kong following an explosion at a power plant.
  • Acting for a European gas interconnector developer, in 2021 and 2022 defending force majeure claims made by its EPC contractor under an amended FIDIC contract. The claims arise primarily as a result of COVID-19.
  • Acting for a global insurance market insuring an international renewable energy company, in relation to damage caused to electrical turbines at several European power plants.

Infrastructure

  • Acting for a government owned transport company, in relation to a final account and delay dispute concerning a NEC contract.
  • Acting for a global reinsurance market in relation to a high-profile dam collapse.
  • Acting on several matters concerning water ingress to schools and universities pursuant to JCT Contracts.
  • Acting for an international owner of a UK student accommodation block in relation to defective fire works.
