Claire Schuster is a talented patent litigator whose practice focuses on high-stakes intellectual property disputes in a variety of industries, including electronics, software, and medical devices in both district court and at the International Trade Commission.

Claire has particular experience in Section 337 Investigations at the International Trade Commission, where she has represented both Complainants and Respondents.  Claire has defended companies in complex disputes against both competitors and non-practicing entities in order to preserve clients’ continued ability to provide customers with state-of-the-art products. 

Claire has also enforced clients’ innovative intellectual property against unauthorized use by competitors.  She has experience in all stages of litigation, as well as the unique procedural aspects of the International Trade Commission.

Represented a respondent against a competitor in an ITC investigation involving solar optimizers and inverters by securing dismissal on the eve of pre-hearing filings
Represented a group of respondents in an ITC investigation involving automobile electronics by securing early dismissal of the investigation
Represented complainant against a competitor in an ITC investigation involving electrical connectors used in servers, security limited exclusion orders and cease and desist orders against respondents after a five-day trial before the ALJ
Represented respondents in multiple joint defense groups against non-practicing entities at the ITC involving mobile devices
Represented respondents seeking approval to import a redesigned product in a Section 177 proceeding before Customs and Border Protection
Represented respondents in an ITC enforcement proceeding, which resulted in an assessed penalty significantly below the statutory minimum after a one-day trial before the ALJ
Represented respondents in an ITC violation proceeding involving magnetic data storage tapes, including a five-day trial before the ALJ

Prior Experience

Prior to joining DLA, Claire worked at an IP boutique law firm in Boston, MA where she represented clients in patent litigations in federal district court and at the International Trade Commission.

Before attending law school, Claire was a medical device engineer focused on systematic problem solving, utilization of statistical analysis, and deployment of quality techniques to solve complex problems and prevent supply chain disruptions.
