Amy Nolan is a lawyer with over 18 years of experience in insolvency, commercial litigation and dispute resolution.

She has advised insolvency practitioners in relation to the recovery and sale of assets, retention of title disputes and secured creditor issues. She has brought and defended insolvent trading claims, uncommercial transaction and preference claims under the Corporations Act 2001 (Cth). Amy has also advised directors of distressed companies on their duties and obligations and has provided advice on Australia's safe harbour regime.

Amy has acted for large Australian and international banks and other financial institutions in relation to both secured and unsecured debt, including security reviews, proceedings in relation to the enforcement of guarantees and mortgages, bankruptcy and winding up proceedings.She also has experience in providing general commercial advice and acting for clients in contractual and property disputes.

EXPERIENCE

  • Acting for receivers and managers in relation to the failure of managed investment schemes - in particular, in relation to associated proceedings in the Federal Court of Australia.
  • Acting for liquidators involved in class actions resulting from the failure of forestry and horticultural managed investment schemes in proceedings in the Supreme Court of Victoria, County Court of Victoria and Supreme Court of New South Wales.
  • Providing advice to a director and shareholder in relation to a failed property development and conducting proceedings in the Federal Court of Australia.
  • Acting for insolvency practitioners in relation to retention of title issues, sales of assets, creditors' meeting issues and secured creditor issues.
  • Successfully managing a major tendered project for a large statutory authority which outsourced its statewide collections process. This included managing the allocation of and implementing necessary internal and external processes, procedures, documents and systems to ensure compliance with the client's contractual requirements and statutory obligations.
  • Acting as counsel on behalf of a trustee in bankruptcy in the public examination of a bankrupt and his related parties in a dispute involving allegedly fraudulent documents.
  • Acting on behalf of major Australian and international financial institutions in relation to the enforcement of securities, particularly the enforcement of consumer mortgages and guarantees.
