Maria Swiatek focuses her practice on intellectual property counseling and transactions for high technology, energy and life sciences companies. Drawing on her prior in-house experience, she takes a pragmatic, business-focused approach, providing strategic intellectual property counseling to clients with emphasis on development and leverage of domestic and international IP portfolios, complex IP transactions, licensing, M&A due diligence and infringement matters. Key areas of concentration include energy, industrial processes, electronic components and semiconductors, material science, chemical formulations and processes, LEDs, telecommunications, software, medical devices, tissue engineering and biophotonics.
In the area of intellectual property, Maria helps clients envision the big picture and align protection of their IP with their business goals, working to develop robust IP strategies which may incorporate multiple forms of protection and activity, including patents, trade secrets, copyrights, trademarks, IP ownership terms in third-party agreements, identification, acquisition or license of key third-party IP assets, monetization strategies, enforcement of IP rights and freedom to operate analysis. In the area of patent prosecution, Maria concentrates on a portfolio approach, helping clients obtain commercially valuable patents in a changing patent law landscape. She also counsels on enforcement of patent rights and assists in post-issuance proceedings.
