For over 35 years, Peter Rashleigh has enjoyed a diverse insurance and commercial litigation practice. This has covered all aspects of liability and insurance law and a broad range of commercial litigation.

His practice has a particular focus on professional liability and professional indemnity insurance, claims handling under professional indemnity schemes and advising local and international underwriters on major cases. Such cases have included the Pyramid class actions and National Safety Council litigation.

EXPERIENCE

  • Advising underwriters on policy coverage and representing underwriters in relation to claims against numerous professionals including accountants, dentists, financial planners, property consultants, insurance brokers, stockbrokers, trustees, lawyers, directors and officers
  • Acting on behalf of the auditors of the failed Pyramid Society during what is reputed to be the largest civil litigation case ever conducted in Australia, involving some 12 Supreme Court actions and in excess of 5,000 claimants
  • Extensive experience of directors and officers insurance from its inception, including policy drafting, advice on policy coverage and representing underwriters' interests in large claims against directors
  • Advising on and handling, crime, fidelity and bankers blanket bond claims
  • Acting in class actions brought by shareholders against directors and, currently, for a major airline in a class action relating to an alleged cartel
  • Advising government instrumentalities (including VicRoads) and other principals in respect of liability, indemnity and insurance programmes in relation to infrastructure and major projects
  • Advising in relation to insurance products and related liability and indemnity issues in respect of project alliances, for both underwriters and insured parties. This has included the creation of a new alliance professional indemnity policy
  • Handling complex professional indemnity claims against a major engineering consulting firm in relation to major construction projects
  • Drafting product advice and policy wordings on behalf of a number of insurers
