About

Emilia Kalecka has many years of experience in advising on individual and collective labour law for Polish and international companies. In particular, she represents employers in various labour law and social security disputes, as well as employment restructuring processes, including individual and group dismissals. Emilia supports multinational corporations in the preparation and negotiation of employment and civil law contracts, including non-competition agreements, in particular for managers. She provides advisory services in all legal and employment phases of setting up a business in Poland, as well as drafting in-house employee regulations, including on remote working, working time, bonus schemes and mobbing.

Emilia has been involved in a number of employee-focused transactions and has extensive experience in conducting legal and employee audits and due diligence projects. She also advises on current issues related to immigration and relocation of workers to Poland.

She has authored and co-authored numerous employment law publications in legal journals and academic periodicals. Emilia also conducts trainings on labour law topics including counteracting mobbing and discrimination in the workplace and legalisation of employment.

EXPERIENCE

  • Advising multinational groups in post-transactional activities in the field of employment law, such as drafting and negotiating new contracts with board members and employment restructuring, including the preparation of an employee-related strategy and relevant documents.
  • Representing a leading IT company in complex litigation brought by a former employee concerning reinstatement. Preparation of an optimal litigation strategy, including gathering evidence, drafting litigation documents, negotiating with opposing counsel and ensuring effective representation of the client's interests throughout the litigation.
  • Providing support to international companies, including leading IT sector companies, in a number of complex issues related to global mobility and relocation of foreign employees to Poland.
  • Providing ongoing advice to international capital groups, including the world leaders in the automotive and household appliances industry, and preparing employment law documentation.
  • Advising one of the world's largest biopharmaceutical companies in over a hundred proceedings initiated by the Social Insurance Institution (ZUS), as well as in court proceedings against the National Health Fund concerning the establishing of compulsory health insurance coverage.
  • Providing ongoing legal support for clients in multifaceted projects related to business alignment, cost-optimisation and organisation of workplaces during the COVID-19 epidemic.
  • Representing clients before the courts in matters relating to labour law and social security contributions, including employment, accidents at work and overtime pay.
  • Supporting Polish and foreign enterprises in the implementation of amendments to remuneration and bonus regulations.
  • Supporting an international energy group in dealing with a serious accident at work.*
  • Providing ongoing support to a multinational pharmaceutical company in carrying out a collective redundancy process.*
