About

Henry advises on a variety of development planning, compulsory purchase and infrastructure work in relation to the consent regimes under both the Planning Act 2008 and the Town and Country Planning Act 1990. He has experience of promoting DCO applications for the approval of major infrastructure projects in the transport and energy sectors, drafting and negotiating section 106 agreements and infrastructure agreements, advising in relation to compulsory purchase and advising on planning policy and strategic planning issues. He has also acted in relation to drafting statutory schemes overseas and in relation to the regulatory processes for the redesign of controlled airspace and water resource management.

Henry’s primary focus is in the energy, transport and real estate sectors.

EXPERIENCE

  • Advising National Highways on the preparation, submission and examination of development consent orders for the A1 in Northumberland, including strategic advice, drafting of development consent orders and review of environmental statements, habitats regulations assessments and the cases for each scheme, including the cases for compulsory acquisition.
  • Acting for HS2 Limited on Phase One of the proposed high speed rail network between London and the West Midlands, including advice on strategic planning, submission of Schedule 17 appeals under the High Speed Rail (London – West Midlands) Act 2017 and work in relation to compulsory purchase / compensation matters.
  • Advising East West Railway Company on optioneering, consultation and protective provisions.
  • Acting for an airport operator in relation to its airspace modernisation project, covering the regulatory process for the redesign of controlled airspace at a number of key UK airports.
  • Advising a port operator in relation to the consenting strategy in respect of a container terminal, including considerations in relation to marine consents and environmental impact assessment in marine environments and the negotiation of associated infrastructure agreements.
  • Advising National Grid in relation to the preparation of a development consent order application, including advice in respect of optioneering, consultation and regulatory considerations and to include future advice in respect of the submission and examination of the application.
  • Acting for a water company in relation to the regulatory process for the preparation of its water resource management plan, including advice in relation to the interaction with regional plans, the requirements for consultation and strategic considerations in respect of future DCO or TCPA applications.
  • Advising a solar operator on the acquisition of a large portfolio of solar sites.
  • Advising on the corporate acquisition and financing of 5 Broadgate, London for circa GBP1.2bn.
  • Advising on the corporate acquisition, redevelopment and financing of 10 Greycoat Place, London.
  • Advising on the acquisition, redevelopment and financing of the Amp (formerly MET) Building in London.
  • Advising a global consultancy practice on the development and drafting of new planning and environmental impact assessment laws in the Middle East, including the audit of existing legislation, engagement with key government stakeholders and drafting of legislation.
  • Advising developers, landowners, local authorities and intermediaries on the Biodiversity Net Gain regime introduced by the Environment Act 2021.
