Emma Dowden-Teale is DLA Piper UK's Head of Public Law and is Global Co-Chair for Public, Constitutional and Administrative law comprising DLA Piper’s public lawyers across the UK, Europe, the Americas and Asia Pacific. Emma is also the Global Co-Lead of the firm's ESG Treating People Fairly pillar, which co-ordinates and supports the firm's intersectional, inter-disciplinary and cross-jurisdictional work in relation to advice on human rights and risk management of potential harm to individuals in connection with organisations' global operations.

Emma advises on all aspects of public law, both contentious and advisory, including in respect of human rights, equality, procurement and inquiries.

Emma is a trusted advisor to government in the UK, and often advises at the intersection between the public and private sector. Her practice includes, on the public sector side, drafting and implementation of legal frameworks, policies, decisions and legislation, as well as defending public bodies in judicial review, human rights claims, equality claims and statutory appeals. Emma also advises private sector clients in the shaping of operations to ensure compliance with relevant legislation, regulation and broader human rights requirements; in respect of procurements; and representing them in challenges to public sector decisions when appropriate.

Her experience reaches the four corners of public law practice. She has previously been seconded to a number of UK public bodies to provide advice as in-house counsel, as well as acting in reviews, inquiries, public law litigation, human rights complaints and constitutional challenges outside of the UK. Emma is particularly adept at advising and litigating in legally and politically dynamic contexts.

Emma is highly experienced in liaising with sponsoring central Government departments and the Office of the Parliamentary Counsel in connection with the production and passage of draft legislation through Parliament and variously drafting and commenting upon legislation, statutory instruments and statutory and other guidance, policies and procedures.

She therefore has a truly 360° view of public law issues: from policy inception, development, related decision-making and implementation, enforcement and potential challenge.

EXPERIENCE

  • Providing detailed legal and strategic advice to a Central Government Department in accordance with the Attorney General's Guidance on Legal Risk regarding policy development, including support on Ministerial submissions and Instructions to the Office of the Parliamentary Counsel and advising in connection with the passage of new legislation through Parliament and its implementation.
  • Advising a non-departmental public body in connection with the review and reform of its overarching strategy and the regulations that relate to its activities. This has included extensive advice in relation to policy optioneering; consultation; decision making; drafting fresh regulations; and liaising with the body's Central Government Department sponsor and the Devolved Administrations in connection with bringing the new regulations into force.
  • Providing regular and extensive advice to a non-departmental public body in connection with the fulfilment of its statutory functions.
  • Advising a body moving from the private to public sector in connection with the functions and duties that it will assume as a result.
  • Leading the team supporting the Government Legal Department in representing a Central Government Department which is a Core Participant in several modules of the Covid-19 Inquiry, regarding its part in the government response to the pandemic.
  • Co-leading a large team of DLA Piper lawyers to defend appeals against a statutory regulator's decisions in the Upper Tribunal.
  • Judicial review of the Valuation Office Agency in connection with business rates.
  • Leading the team in bringing a successful judicial review on behalf of Birmingham City Council regarding the decision to discontinue funding for a long-standing PFI arrangement.
  • Leading the team in connection with a judicial review brought by Halton Borough Council in connection with decisions of the Road User Charging Adjudicators in relation to the operation of tolling on the Mersey Gateway Bridge.
  • Advice to an entertainment company in relation to the handling of allegations of abuse.
  • Representing an organisation in relation to Equality and Human Rights Commission regulatory action.
  • Bringing and defending challenges to the award of contracts following public procurement.
  • Advising investors in renewable energy regarding international human rights obligations.
