Partners Stacy Marcus (New York) and Kate Imp (Los Angeles) had a discussion on the negotiation of influencer and celebrity endorsement agreements, highlighting the intersection of entertainment and advertising practices.

The discussion on SAG-AFTRA included:

  • Whom SAG-AFTRA represents
  • What collective bargaining agreements apply to influencer deals or endorsement deals
  • What payments are due and to whom
  • Key contract terms to include in performer agreements covered by SAG-AFTRA
  • Common pitfalls to avoid
  • What to expect with re-negotiations of the Commercials Contract in 2025

Stacy Marcus, who recently joined the Trademark, Copyright, and Media sub-practice group and Media, Sport, and Entertainment sector, led the discussion from her perspective as Chief Negotiator of the Joint Policy Committee (JPC) and a trustee on the SAG-AFTRA Health Plan and SAG-Producers Pension Plan. Stacy was the first woman to serve as Chief Negotiator in the JPC’s half-century existence.

Kate Imp, from the Sports, Media, and Entertainment Finance and Transactions sub-practice group, complemented the discussion with her experience negotiating these types of agreements on behalf of brands and media companies.
