Monday, December 16, 2024

This webinar is the second in a series focused on the 2024 US election and implications for tax policy and corporate tax planning.

Partner Evan Migdail and Managing Director Melissa Gierach from the DLA Piper Tax practice's Washington, DC-based team focused on tax policy discussed what’s next for international tax considerations.

Our speakers conducted an informative discussion covering:

  • Budget Reconciliation in focus, and what role our nation’s fiscal circumstances may play
  • How might Congress address offsets in the expected tax bill?
  • Review of tax-writing committee and agency nominations and leadership positions and early implications for tax reform
  • Overview of international tax considerations in the face of Pillars 1 and 2 and the expected 2025 tax bill

The goal of this series is to provide insights on strategic legislative approaches, tax planning perspectives, and legal foresight to help maximize tax policy positions of interest to a company's stakeholders involved in fiscal planning decisions, such as individuals from businesses' finance, treasury, tax, and legal teams.

This webinar focused on the 2024 election and implications for tax policy and corporate tax planning.

As the dust settled one week post election, Evan Migdail and Melissa Gierach from the tax practice's Washington, DC-based team focused on tax policy helped unpack the returns at the presidential and congressional levels and discuss the pathways forward. Regardless of the election's outcome, the "Super Bowl" of tax legislation is expected in 2025 – and it may affect the corporate tax rate and numerous other provisions that stand to impact our clients' bottom line.

Our goal was to provide insights on strategic legislative approaches, tax planning perspectives, and legal foresight to help maximize tax policy positions of interest to company stakeholders involved in fiscal planning decisions, such as individuals from businesses’ finance, treasury, tax, and legal teams.

Our speakers conducted an informative discussion covering:

  • Top and down-ballot election results with a focus on tax-writing committee election outcomes.
  • Scenario-mapping for how election results may impact the 2025 tax landscape, including:
    • Retrospective changes to domestic tax policy
    • Considerations in International tax policy on go-forward basis
  • Areas of domestic and international tax policy ripe for change.
  • Implications for structuring M&A transactions, capitalization of businesses, and tax incentives such as transferable and refundable tax credits (currently available through the Inflation Reduction Act), research & development tax credits, and more.
