Class Actions continue to rise across Europe. The European Collective Redress Directive required EU member states, by June 2023, to fully implement the EU Directive on Representative Actions for the Protection of the Collective Interests of Consumers (the Representative Actions Directive, or RAD), for consumers to seek collective redress when they claim to have been harmed by a business through breaches of certain European consumer laws.

Our international team has for many years been forecasting and keeping our clients informed of the pan-European system of Class Actions. Following the success of our Race Around European Class Actions - Part 1 webinar in May, which focused on the impact of RAD in Belgium, Italy, France, Germany, Ireland, the Netherlands and the UK, we invite you to the second part of our series where our pan-European panel will scan the horizon and offer predictions for European Class Actions alongside insights into key jurisdictions including Austria, Luxembourg, Sweden, Portugal, Hungary and Poland. We will also hear from the Netherlands and the UK for updates on those markets since we spoke in May.

This Directive has major consequences for all types of businesses – from technology to manufacturing and ESG.

We will discuss:

  • What kinds of disputes does the RAD affect?
  • Which European countries have already implemented RAD and which have not?
  • What is the impact of the ‘opt-in’ and ‘opt-out’ systems?
  • Which sectors are most likely to be affected?
