About

Kate Rogers has a focus on resource management law. She works in the environment, planning and natural resources team in our Wellington office, advising local and central government clients on all aspects of resource management and other regulatory issues. She also has a specialist enforcement practice.

EXPERIENCE

  • Regularly appearing in the Court in relation to enforcement matters. She has acted for many local authorities in relation to enforcement action under the Resource Management Act, the Building Act, the Health Act and Bylaws. She is currently instructed on a range of active prosecutions and has successfully acted for Council clients in obtaining enforcement orders. She is also instructed in relation to other enforcement litigation, including abatement notice appeals, and has been involved in a number of enforcement matters under the Building Act, including seeking orders in relation to dangerous buildings.
  • Acting for Councils in relation to plan drafting, reviews and appeals. This has included providing advice to Councils on their regulatory obligations, interpretation issues, section 32 requirements, scope and extensive experience assisting with the initial Council hearing process and then appeals, including preparation for, and attendance at, mediations – sometimes in mediation processes that last over a year in duration.  
  • Providing advice to Councils on the implementation of the central government Resource Management (Enabling Housing Supply and Other Matters) Amendment Act 2021, including its relationship with ongoing Council and private plan changes, and the process for implementing the required Intensification Planning Instruments.
  • Providing advice on the implementation of national direction, including the National Policy Statement for Freshwater Management and the Resource Management (National Environmental Standards for Freshwater) Regulations 2020, and the National Policy Statement for Highly Productive Land (NPS-HPL) to Councils, including appearing for Council in two of the few Court decisions on the NPS-HPL.
  • Completing environmental due diligence review for land and commercial purchases.
