James Wong is a Senior Associate in the Litigation and Regulatory team of DLA Piper Hong Kong. He specialises in cross-border dispute resolution, with a focus on disputes with a China element.

He has a broad practice which covers commercial litigation, shareholders’ disputes, enforcement of distressed debts and securities, professional negligence, bankruptcy and corporate insolvency, product liability, and international arbitration.

He had spent one year on secondment to a Chinese SOE. He is experienced in advising creditors, debtors and corporations on projects involving distressed debts with complex security arrangement.

EXPERIENCE

  • Acted for a British wine merchant group in four sets of Hong Kong court actions against its former Hong Kong distributor. The actions involved multiple claims, including unpaid invoices for wines delivered, breach of confidence, misappropriation of trade secrets and client information, and breach of fiduciary duties.
  • Acted for a high net-worth individual in his disputes with an asset management company relating to the intended sale and purchase of a holding company of real estate in Mainland China. The transaction involved security arrangement of offshore holding companies of assets in Hong Kong, Mainland China, and San Francisco.
  • Acted for a PRC listed company in its disputes with a Hong Kong company and its Beijing parent company, relating to various data centres in Hong Kong, Singapore and Frankfurt.
  • Acted for a Chinese SOE in its enforcement action of a PRC Judgment in Hong Kong. Successfully obtained a Mareva injunction restraining the Defendant’s disposal of her assets in Hong Kong.
  • Acted for a Japanese tycoon in resisting the enforcement action by an arbitral award creditor. The creditor launched multiple enforcement actions in the US, Hong Kong and Tokyo.
  • Acted for various international and local law firms in defending claims in professional negligence.
  • Acted for a garment manufacturing group in its professional negligence claims against two audit firms. Achieved a favourable settlement against each defendant firm.
  • Acted for a British footwear and clothing brand in defending claims of their former Hong Kong distributor, relating to the termination of the distributorship arrangement.
  • Acted for a Chinese SOE in a HKIAC arbitration, which involved claims for outstanding principal and interest in two related secured loan transactions.
  • Acted for a Thai airline in a SIAC arbitration against a leading European provider of aviation maintenance, repair and overhaul services, relating to a dispute arising out of the termination of various aircraft service agreements.
  • Acted for a Japanese electronics company in a Hong Kong arbitration concerning claims for defective electronic products against its former supplier in Hong Kong.
  • Acted for US based manufacturing company in a HKIAC arbitration against its former Chinese supplier, in connection with misappropriation of trade secrets, know-how and designs relating to automobile parts and various breaches of a master supply agreement.
  • Advised a Korean biopharmaceutical company in relation to its claim against an Indian contractor for the latter's failure to perform its contractual obligations properly in relation to the development and manufacture of pharmaceutical products.
