DLA Piper secures significant FTC victory on behalf of MGM Resorts International

DLA Piper and MGM Resorts International successfully resolved the Federal Trade Commission’s investigation of MGM. The FTC withdrew its Civil Investigative Demand (CID), terminated its enforcement action, and closed its investigation. In turn, MGM agreed to dismiss its constitutional challenge to the FTC’s investigation and its Rules of Practice. In a statement, MGM said the CID "issued by the former Chair of the FTC was a dangerous over-reach…We're pleased that the new Chair has withdrawn it."

The DLA Piper team was led by Brian J. Boyle, Deputy Chair of DLA Piper’s US Antitrust & Competition Practice, and included Andrew B. Sacks, Brett M. Feldman, and William Conway.

The case is MGM Resorts International v. Federal Trade Commission et al., case number 1:24-cv-01066, in the U.S. District Court for the District of Columbia.
