Sam Ip is a member of the insurance, construction and litigation groups with extensive experience representing clients in the private insurance, construction and engineering sectors. 

Sam has advised leading domestic and international insurers on a multitude of high value coverage assignments, including course of construction, directors and officers, errors and omissions, commercial property and commercial liability policies. Sam also acts as risk management and monitor counsel on all related coverage risks. 

As part of her construction law practice, Sam assists with contract drafting and negotiations, tender disputes, liens and professional negligence claims. She also regularly advises on delay, productivity and acceleration claims and deficiency claims, including technical subject matters such as refractory linings, feller bunchers and other heavy machinery, piping, glazing, tiling, cement applications, processed wood, roofing and building envelope related deficiencies.

Sam has appeared before all levels of court in British Columbia, in addition to various tribunals. Among her many accolades, Sam won a precedent-setting lawsuit enforcing corporate identification principles and creating new law in Canada on insurance covenants. 

Delivering results that matter, Sam provides applicable advice on which clients can base decisions and take action. With her instincts and experience, Sam thinks on her feet and anticipates the opposition’s next move, instilling confidence in her clients both in and out of the courtroom.

Although disputes are adversarial, Sam believes in the power of people and problem solving. She leads negotiations and litigations to address the human element of resolution and persuades the court in our clients’ favour through advocacy and with integrity.

EXPERIENCE

  • Acted on precedent-setting lawsuit enforcing corporate identification principles and creating new law in Canada on insurance covenants.
  • Advised on numerous claims related to course of construction policies ranging from smaller construction projects to large infrastructure projects quantified at over $100 million.  
  • Counsel for Underwriters on contentious and disputed property coverage matters in various industries, the largest of which has been quantified at $110 million.  
  • Lead coverage counsel on a wrap policy with a potential underwriting exposure of $80,000,000 in the context of an underlying construction defects lawsuit. 
  • Advised on a project-specific errors and omissions policy related to catastrophic failure of a biowaste processing facility resulting in alleged losses of $40 plus million and in respect of multiple contentious insureds. 
  • Advised Underwriters in policy voidance in the context of a fire loss and triggering of warranty as condition precedent to coverage for a loss quantified at $1.6 million. 
  • Lead coverage counsel in a $20 million multi-policy coverage claim related to damage to sensitive and rare artifacts arising from inappropriate supply and installation of display cases involving harmful chemical emissions.   
  • Coverage counsel for Underwriters on a directors and officers policy in respect of a $50 million securities class action against multiple insureds and a BC Securities Commission proceeding.  
  • Coverage counsel on the excess policy issued by Underwriters to provide liability coverage to lawyers sued in a negligence suit related to improper issuance of securities.
  • Coverage counsel on commercial policies responding to historical abuse claims.  
  • Coverage counsel for a municipal reciprocal exchange to update subscriber agreements and ongoing contracts with vendors, as well as to provide coverage advice on ongoing claims in the insurance program.
  • Provided Underwriters with reinsurance advice on the obligations of its reinsurer on a complex underlying loss.
  • Coverage counsel to a number of drug related product liability class action lawsuits.
  • Counsel for the purchaser of sulphuric in 11 simultaneous lawsuits with a total quantum exposure of $50 million in claims. 
  • Counsel for a US and Canadian refrigeration company in the context of a wrongful death suit. 
  • Advised a structural consultant in a $60 million lawsuit for an institutional building in the Maritimes.
