Marietta Rivero is a litigation lawyer with experience representing national and multinational companies in the railway, oil and gas, telecommunications, economic competition and privacy sectors on administrative litigation and constitutional remedies.

Marietta also has experience representing companies before the Mexican Federal Economic Competition Commission in investigations concerning anticompetitive practices.

In telecom matters, she has represented companies before the Mexican Federal Telecommunications Institute in proceedings for the determination of interconnection rates, award of licenses for the use of frequency bands, their extension and renewal.

  • Representation of a leading company in the distribution and sale of LP Gas before the Federal Economic Competition Commission in the following proceedings:
  • Proceeding for the suspected engagement in monopolistic practices (prima facie unlawful) in the market of distribution and sale of LP Gas.
  • Investigation proceeding for the suspected engagement in monopolistic practices (subject to the rule of reason) in the market of distribution and sale of LP Gas.
  • Investigation proceeding for the determination of conditions of effective competition in the market of distribution and sale of LP Gas.
  • Representation in an amparo proceeding of a leading company in the distribution and sale of LP Gas against a resolution issued by the Federal Antitrust Commission for its alleged participation in monopolistic practices.
  • Representation in an amparo proceeding of the Asociación Mexicana de Ferrocarriles, A.C. (AMF) against the issuance of NOM-EM-001-SADER-SE-ARTF-2022, which sought to impose an emergency regulation in the railroad sector and limit the concessionaire’s tariff freedom.
  • Representation of one of the most important telecommunications companies in a series of amparo actions against several resolutions issued by the Federal Institute of Telecommunications (Instituto Federal de Telecomunicaciones).
  • Representation of a financial group against the imposition and publication of fines by the CNBV.

    Successfully represented Mexicanos Primero, an education-focused nongovernmental agency, in a lawsuit related to proposed cutbacks to the “School is Ours” program, which extends to approximately 30 million children at more than 25,000 schools in rural Mexico.

    • Representation of a concessionaire before the Federal Institute of Telecommunications (IFT) in a proceeding for the allocation and extension of frequency bands for the operation of the railway service and in a verification and imposition of sanctions proceeding in which the Client could have been fined for up to 0.75% of its income.
    • Participation in the defense of a licensee of a public telecommunications network in two amparo trials against the public bidding and adjudication of the 2.5 GHz frequency band.
    • Participation in several amparo trials against the determination of interconnection rates for the years 2018, 2019, 2020 and 2021
    • Participation in multiple amparo trials against resolutions of the Federal Institute of Telecommunications (IFT) in relation to complaints filed for the breach of the conditions laid down in the “Resolution of Preponderance” (Resolución de Preponderancia.
    • Representation of a manufacturing company in an amparo proceeding, against a resolution issued by the INAI for violations to the law of Protection of Personal Data in Possession of Private Parties. Culminated with a favorable ruling.
