Dr Markus Kaul represents clients in international and domestic arbitration and commercial litigation matters, with an emphasis on disputes in the automotive and IT sectors as well as in the area of liability law for professionals (e.g. lawyers, notaries, tax consultants, auditors).

He has extensive experience in cross-jurisdictional dispute resolution and also acts as an arbitrator.

EXPERIENCE

  • Representing a globally leading chemicals group in a large-volume ad hoc arbitration in connection with a complex contractual dispute.
  • Advising and representing a German car manufacturer in various supply chain disputes against national and international suppliers (including price adjustments, supply shortages and delivery stops.
  • Representing a globally operating automotive supplier in a price adjustment dispute with a sub-supplier.
  • Representing a leading international insurer in several DIS arbitration proceedings against claims arising out of warranty & indemnity (W&I) insurances for alleged breaches of guarantees under the respective SPA (including related proceedings before state courts).
  • Defence of several auditing and tax consulting firms in court disputes with an insolvency administrator due to alleged auditing/consulting errors.
  • Defence of a law firm against a former client due to alleged errors in litigation handling.
  • Acting for global insurance groups in relation to the worldwide enforcement of recourse claims.
  • Representing an US-based third party funder in enforcing a payment claim secured by a pledge of shares in a German stock company against a debtor in Panama.
  • Advising a limited liability company (GmbH) in a complex shareholder dispute, including representation in numerous injunction proceedings, actions to set aside shareholders’ resolutions and arbitrations.
